Bulqe is a new content management system (CMS) for dropshipping that allows users to create and administer their own online stores. These terms and conditions (the "Terms") govern how you can use and access Bulqe's services, such as the Bulqe website, mobile apps, and any other services that Bulqe provides (collectively, the "Service"). Please read these terms thoroughly before using the service.

You agree to be bound by these terms when you use or access the service. You will not be able to use or access the service if you do not agree to these terms.

Policy on privacy

Bulqe wants to keep your information private. We collect information about you in order to provide the service and make it easier for you to use. Please read our privacy policy to learn more about what we do and what you can do.

Contracts for Service and Registration

To utilize the service, you must create an account. As part of the registration process, you may be required to provide personal information such as your name, email address, and password. You are responsible for keeping your password secure and for anything that occurs with your account. You promise to notify Bulqe immediately if your account is used by someone else without your permission.

Bulqe has the right to delete or suspend your account at any time and for any reason, including, but not limited to, if it thinks you have broken the rules.

The Pass Key (passwords)

Keep your Bulqe account pass key (password) safe. You should not use a passkey from another service for your Bulqe account. Instead, create a one-of-a-kind pass key. If you suspect that your pass key has been stolen, update it immediately and notify Bulqe.

Authorization

By using the service, you agree and indicate that you are at least 18 years old and have the legal capacity to enter into a contract. If you use the service on behalf of a company, you represent and warrant that you have the ability to bind that company to these terms.

General

These Terms govern both your relationship with Bulqe and your use of the Service.These guidelines supersede any previous agreements you and Bulqe may have made. When you use or purchase some other Bulqe services, affiliate services, third-party content, or third-party software, you may be required to agree to additional terms and conditions.

If any portion of these Terms is deemed invalid or unenforceable, that part will be enforced to the greatest extent practicable, and the remaining sections will remain valid and enforceable.

Bulqe's failure to use or enforce any right or term of these Terms does not imply that Bulqe waives that right or term.

Bulqe reserves the right to assign all or a portion of these Terms to another party at any time and without notice to you. You may not transfer these Terms or give another person the right to use the Service without first obtaining Bulqe's prior approval.

Bulqe is not liable if it fails to meet its duties under these terms due to events beyond its control. This includes, but is not limited to, acts of God, war, terrorism, riots, and embargoes, acts of civil or military authority, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

You may not transfer or sell these Terms or the rights and licenses they grant you. Bulqe, on the other hand, can give or sell them to anyone.

These terms do not create any agency, partnership, joint venture, employment, or franchise relationship.

Bulqe may notify you of changes to these Terms via email, regular mail, or by posting notices on the Service.

Bulqe reserves the right to amend these terms at any time, and the changes will take effect as soon as the new terms are posted. If you continue to use the service after the terms have been amended, it means you agree to the new terms. You are responsible for regularly reviewing these terms.

You agree that these terms, along with the privacy policy, constitute the entire agreement between you and Bulqe about the service. They replace and take the place of any other offers, agreements, or communications.

The property or Service

The Service and all of its content and elements, including text, graphics, logos, pictures, and software, are the property of Bulqe or its licensors. They are protected by copyright and trademark laws in the United States and around the world. You can't use any of the service's content or resources for any kind of business without Bulqe's permission.

Links to Other Websites

The service may contain links to websites or services operated by third parties that Bulqe does not own or control. Bulqe has no control over the content, privacy policies, or practices of third-party websites or services and accepts no responsibility for them. You accept that Bulqe is not responsible for any of these third-party websites or services and does not advocate any of them.

Termination

Bulqe reserves the right to prevent you from using the service or suspend your access to it at any time and for any reason, including, but not limited to, if it believes you have violated these terms. After the agreement expires, you will no longer be able to use the service.

Laws that apply

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the European Union, including all relevant global environmental laws and customer privacy and security laws while drop-shipping in Europe, without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the courts located in the European Union to resolve any legal matter arising from these Terms or the Service.

These Terms and your use of the Service will be governed and interpreted by California law, regardless of any rules governing how different laws interact with one another. You agree that the courts in San Francisco County, California, are the only ones who can handle any legal issues that arise as a result of these Terms or the Service.

Dispute Resolution

Any disagreements about these terms, the service, or anything else related to them will be resolved through discussion and mediation. If the parties are unable to reach an agreement through negotiation and mediation, the disagreement will be resolved by arbitration under the rules of the American Arbitration Association. The arbitration will take place in San Francisco, California.

Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be upheld as much as possible, while the rest will still be legal and enforceable.

Waiver

Bulqe's failure to use or enforce any right or term of these Terms does not imply that Bulqe waives that right or term.

Total Agreement

These Terms constitute the sole agreement between you and Bulqe, and they govern your use of the service. They supersede any other agreements you and Bulqe have signed.

 

 

Disclaimer

The service is provided "as is" and "as available." Bulqe makes no express or implied claims or warranties regarding how the service works or about the information, content, materials, or items available through it. Bulqe does not guarantee that the service will operate without interruptions or errors, and it will not be liable for any that do occur.

By using the service, you agree to and accept these terms as well as the policies and practices they describe. Bulqe reserves the right to amend these terms at any moment, so please review them frequently. If you continue to use the service after any of these changes, you consent to such changes.

Indemnification

You agree to indemnify Bulqe and its affiliates, directors, officers, and employees against any claim or demand made by a third party arising from or connected to your use of the Service, your violation of these Terms, or your violation of someone else's rights.

Limiting who is accountable

Bulqe is not liable for any damages resulting from the use of the service. This includes direct, indirect, incidental, punitive, and consequential damages.

 Changes to the Service

Bulqe reserves the right to modify or discontinue the service at any time and without notice. Bulqe is not liable to you or anyone else if the service is changed, its pricing changes, or it is stopped or shut down.

Pricing

Bulqe may adjust the price of the service at any time. Any pricing adjustments will be posted on the Bulqe website and will take effect as soon as they are posted. If you continue to use the service after the pricing has changed, you consent to the new price.

Refunds

Bulqe does not offer refunds for the service. All sales are final.

User-generated content

Users may be able to post, upload, or email content (such as text, photos, and videos) over the service (collectively, "User Generated Content"). You are aware that by using the service, you may be exposed to user-generated content that is offensive, inappropriate, or dangerous. Bulqe is not responsible for making sure that user-generated content is right, complete, safe, and legal.

By submitting User Generated Content to the Service, you grant Bulqe a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, edit, publish, distribute, and display the User Generated Content in connection with the Service. You state and guarantee that you have the authority to grant this license and that the user-generated content does not infringe on anybody else's intellectual property rights.

Bulqe reserves the right to remove any content created by users at any time, for any reason, and without notice.

Code of Conduct

You undertake to only use the service in ways that are lawful and in accordance with these Terms. You agree not to use the service to:

• User-generated content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of privacy, hateful, or racially, ethnically, or otherwise offensive may not be uploaded, posted, or distributed in any other way.
• Impersonate anybody or anything, including, but not limited to, a Bulqe employee, or lie about or misrepresent your affiliation with someone or something;
• You may not upload, post, or send user-generated content that you do not have the legal authority to send due to a law, a contract, or a fiduciary relationship. For example, you cannot send inside information, proprietary information, or sensitive material that you learned or disclosed as part of your job or as part of a non-disclosure agreement.
• User-generated content that violates a third party's patent, trademark, trade secret, copyright, or other intellectual property right cannot be uploaded, posted, or distributed in any other way.
• You may not upload, post, or email any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other kind of solicitation.
• Upload, upload, or transfer any content containing software viruses or any other computer code, files, or programs designed to stop, destroy, or limit the performance of any computer software or hardware, or telecommunications equipment;
• Interfere with or disrupt the service or any servers or networks linked to the service, or violate any rules, policies, or procedures of networks connected to the service;
• Intentionally or unintentionally violate any applicable local, state, national, or international law, including, but not limited to, regulations issued by the Securities and Exchange Commission, rules of any national or other securities exchange, and any regulations with legal effect;
• "Stalk" or otherwise disturb someone else;
• Gather or store other users' personal information.

Bulqe reserves the right, but not the responsibility, to monitor User Generated Content and remove any User Generated Content that, in Bulqe's sole discretion, violates these Terms or harms the Service in any other manner. If you violate any of these rules, Bulqe may also terminate or restrict your use of the service.
